Types of Burn Injuries

Burn injuries are categorized based on extent and severity. The more severe the burn, the more treatment required. Very severe burn injuries can even result in death.

The three main categories of burn injuries are:

First-Degree Burns: Generally considered to be relatively mild when compared to other types of burns, first-degree burns affect only the top layer of skin (epidermis). These types of burn-injuries can result in pain and redness at the burn site.

Second-Degree Burns: More severe than first-degree burns but less severe than third-degree burns, second-degree burns affect both the outer layer of skin (epidermis) and the lower layer of skin (dermis). They often result in pain, redness, swelling, and blistering at the burn site.

Third-Degree Burns: Third-degree burns are the most severe type of burn injury. These burns penetrate both layers of skin and affect underlying tissue and, in very severe cases, bone. They often result in blackened or charred skin, whiteness of the skin, numbness, and tissue damage

How Severe Burns Occur

Burn injuries can be severe and may cause lifelong deformity and/or disability. These types of injuries are often classified as “catastrophic” due to their damaging nature. While many assume burns are solely caused by fires, this is not the case. Burns can also be caused by water, steam, chemicals, defective products, and even medical malpractice.

Burn injuries can be caused by many types of accidents and mishaps, including:

  • Workplace accidents/explosions
  • Car accidents
  • Commercial / recreational fires
  • Daycare incidents
  • Sporting activity accidents
  • Truck accidents
  • Tanker explosions
  • Restaurant incidents
  • Pedestrian accidents
  • Motorcycle accidents
  • Household fires
  • Apartment building fires
  • Defective product accidents
  • Electrical accidents
  • Medical malpractice

If the accident that caused your injuries can be attributed in whole or in part to the actions or negligence of a third party, you could be entitled to compensation for your injuries. This includes compensation for your medical expenses, missed paychecks, physical suffering, scarring, and more.

Compensation in Burn Injury Cases

Determining compensation for a burn injury rests on a variety of factors. Each victim’s individual case will vary according to their circumstances and, subsequently, to the compensation awarded.

The most significant factors considered in awarding compensation are the following:

  • The severity of the burn
  • Type of burn (electrical, chemical, or thermal)
  • Percentage of skin area involved in the burn
  • Location of the burn
  • Amount of medical care necessary to treat the burn
  • Emotional injuries (such as depression due to pain or scarring)
  • Extent and permanency of the scarring
  • Long term physical therapy required to treat burn

Medical Malpractice Burn Injury

One of the least expected places to experience a burn injury is at the hospital, or other health care location. Unfortunately, medical malpractice can result in serious burn injuries to patients.

Victims of medical malpractice-induced burn injuries often experience these:

  • Thermal burns: As a result of a misplaced instrument or lap pad (i.e. cautery instrument)
  • Radiation burns: As a result of negligent cancer treatment
  • Electrical burns: As a result of a piece of equipment used during a medical procedure
  • Laser burns: As a result of cosmetic surgery
  • Chemical or medication burns: As a result of an IV or form of medication

In addition, the negligent treatment of a burn can result in charges of medical malpractice. Negligent treatment could include a failed dermabrasion procedure, cosmetic procedure, skin graft error, infection, or bleeding.
