How Uber & Lyft Insurance Coverage Works
In March of 2016, Governor Terry McAuliffe signed legislation that allowed Uber to legally continue operating in the state of Virginia. This legislation also outlined strict regulations and rules for Uber drivers.
All Uber (and Lyft) drivers in the state of Virginia are required to carry primary liability insurance of $1 million. However, this is only in effect when a ride is in progress. In other words, if an Uber or Lyft driver accepts your ride request, you are covered for the entire duration of the ride, from the moment you are picked up until the moment you are dropped off.
Pedestrians and other motorists that are hit by Uber and Lyft drivers that have the app switched on but have not yet accepted a ride (or, in other words, do not have a passenger) may still be covered by both the Uber/Lyft driver’s own insurance policy and/or Uber/Lyft’s contingent liability coverage. Generally speaking, this contingent coverage goes into effect when the driver’s own policy doesn’t provide enough coverage. Both Uber and Lyft offer contingent liability coverage of $50,000 per person or $100,000 maximum per accident.
If an Uber or Lyft driver does not have the app turned on (meaning he or she is not currently working for Uber/Lyft) at the time of an accident, claims will have to go through the driver’s private insurance policy.
